Terms of Service

These Terms cover your use of theocmaker.com and The OC Maker (the "Service"). The Service is run by Jianwei Li, sole trader, Building 11, Liyuan Xincun, Majialong Community, Nantou Subdistrict, Nanshan District, Shenzhen 518052, Guangdong Province, People's Republic of China, support@theocmaker.com ("we", "us"). By using the Service you agree to these Terms.

What the Service does

Some features use automated or AI models. Their output can be wrong or incomplete; check it before you rely on it. You are responsible for how you use it.

• Characters, ref sheets and bases: Nano Banana 2 (Gemini image model) by Google (draws the images, through the Yir AI gateway).
• Example characters on this site: GPT Image 2.5 by OpenAI (drew the sample OCs, ref sheets and bases you see on the pages, through the Nova AI gateway).
• Headcanons, names and OC ideas: GPT-4.1 mini by OpenAI (writes the text tools' lists, through the AIsa AI gateway).
• Content checks: omni-moderation by OpenAI (checks what you type, the pictures you upload and every result).

Content rules

The full rules are in our Acceptable Use Policy, which is part of these Terms. In short, you may not upload or generate:

1. pornography or any sexual content (NSFW);
2. violence or gore;
3. hate speech;
4. anything that sexualizes or endangers children (CSAM);
5. deepfakes or impersonation of real people, whether or not they agree;
6. content that infringes someone's copyright or trademark.

Reporting. Email support@theocmaker.com with "Report" in the subject. Every report is handled by a person; the timetable is in the Acceptable Use Policy.

What we do about breaks. Depending on how serious it is: a warning, deleting the content, forfeiting credits, suspending the account, or a permanent ban, and reporting to the authorities where the law requires it.

Accounts

You must be at least 13 to use the Service. Keep your login details safe; you're responsible for what happens in your account. If you're under 18, you need a parent or guardian's permission to buy anything.

Purchases

Paid plans are billed in advance, monthly or yearly, until you cancel. You can cancel any time in Settings → Billing; you keep the plan until the end of the period you paid for, and it doesn't renew.

Credits come in one-time packs. Nothing renews. Credits stay valid for 12 months from the day they're added to your account; after that, unused credits expire. Credits have no cash value and can't be paid out or transferred.

Prices are shown on the pricing page. Sales and payments are handled by Waffo Hong Kong Limited as Merchant of Record, which is the seller of record and takes care of payment, tax, receipts and refunds; your purchase shows as "The OC Maker" on your card statement. We provide the Service itself. Refunds are covered in our refund policy.

Fair use

Don't try to disrupt the Service, get around limits, reverse-engineer it, or use it for anything illegal. You keep the rights to what you upload and must have the right to upload it. We may block access that breaks these rules.

Availability and liability

We work to keep the Service running but can't promise it will always be available or error free. The Service is provided "as is". To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing here limits consumer rights that can't be limited by law.

Changes and ending use

We may update these Terms; the date at the top shows the latest version, and each purchase is governed by the version in force when you made it. You can stop using the Service and delete your account at any time from Settings.

Governing law

These Terms are governed by the law of the People's Republic of China. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
